A bill that would allow a person to sue for the wrongful death of an unborn child under Mississippi’s wrongful death statute has passed in the House.
House Bill 1338 states, “Whenever the death of any person or of any unborn child shall be caused by any real, wrongful or negligent act or omission, or by such unsafe machinery, way or appliances as would, if death had not ensued, have entitled the party injured or damaged thereby to maintain an action and recover damages in respect thereof, or whenever the death of any person or of any unborn.”
House Bill 1338 was filed by Rep. Chris Brown of Aberdeen and passed 78-37. The bill now goes to the Senate for consideration.
